1. Acceptance of Terms
By creating an account on Build to Own Club ("the Platform"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Platform.
2. Nature of the Service
Build to Own Club is an educational platform. We provide learning materials, tutorials, guides, code examples, and community resources to help you build software tools using AI-assisted development.
All content is provided for educational purposes only. We are not a software development agency, consulting firm, or managed service provider.
3. Your Responsibilities
By using the Platform, you acknowledge and agree that:
- You are solely responsible for any code you write, generate, download, deploy, or execute as a result of following our educational content.
- You are responsible for reviewing, testing, and validating all code before using it in any environment, especially production.
- You are responsible for the security, compliance, and legality of any software you build.
- You will not use the Platform or its content to build software intended to cause harm, violate laws, or infringe on the rights of others.
- You are responsible for maintaining the security of your account and password.
- Any software you install, commands you execute, server configurations you modify, or system changes you make on your own hardware or rented infrastructure (including VPS, Raspberry Pi, or any other device) are entirely at your own risk.
- You are responsible for understanding any terminal command before executing it, including commands suggested by AI tools. Never run a command you do not understand.
4. Disclaimer of Warranties
The Platform and all content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the content is accurate, complete, reliable, or error-free
- Warranties that code examples or tutorials will produce secure, bug-free, or production-ready software
- Warranties that AI-generated or AI-assisted code is safe, correct, or suitable for any purpose
- Warranties that terminal commands, installation instructions, or system configuration steps will not cause damage to your hardware, software, data, or network
We make reasonable efforts to provide quality educational content, but we cannot guarantee outcomes. Software development inherently involves risk, and AI-assisted development introduces additional variables outside our control.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Build to Own Club, its owners, operators, contributors, and affiliates shall not be liable for any:
- Direct, indirect, incidental, special, consequential, or punitive damages
- Loss of data, revenue, profits, or business opportunities
- Security breaches, data leaks, or vulnerabilities in software you build
- Damages arising from malicious code, supply chain attacks, or compromised dependencies
- Damages arising from third-party tools, APIs, libraries, or AI models referenced in our content
- Any damages arising from your reliance on the Platform's content
This limitation applies whether the claim is based on warranty, contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
6. Indemnification
You agree to indemnify and hold harmless Build to Own Club and its owners, operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Platform
- Software you build using our educational content
- Your violation of these Terms
- Your violation of any law or regulation
- Your violation of any third party's rights
7. Third-Party Tools and Services
Our educational content may reference third-party tools, libraries, frameworks, APIs, and AI services. We are not affiliated with, endorsed by, or responsible for any third-party service. Use of third-party tools is subject to their own terms and conditions.
You are responsible for reviewing the licensing terms of any open-source software, AI models, or APIs you use in your projects.
8. Community Events and Build Challenges
Build to Own Club hosts build challenges, events, and community activities from time to time. Regarding these:
- Participation in build challenges, events, and community activities is entirely voluntary.
- If a challenge involves building for a third-party organization (nonprofit, community org, etc.), any agreement between you and that organization is solely between you and them. Build to Own Club is not a party to any such agreement.
- Build to Own Club does not guarantee, endorse, or take responsibility for any work product created during challenges.
- You are responsible for ensuring your work complies with applicable laws and respects the rights of any third party you build for.
9. Membership and Pricing
Build to Own Club membership is free. All members get full access to the Platform at no cost.
- Membership is free for all members.
- We may introduce paid tiers in the future; existing members will be notified in advance of any changes.
- Refund policy: Contact hello@buildtoown.club within 30 days of payment for a full refund.
- We reserve the right to modify membership tiers and pricing with reasonable notice.
10. Intellectual Property
Our Content: Educational materials, course content, designs, and branding on the Platform are owned by Build to Own Club. You may not reproduce, redistribute, or resell our content without permission.
Your Code: Any software you build using our educational content belongs to you. We claim no ownership over code you create.
11. Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or use the Platform for unlawful purposes. You may delete your account at any time by contacting us.
12. Modifications
We may update these Terms from time to time. We will notify registered users of material changes. Continued use of the Platform after changes constitutes acceptance.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Portugal. Any disputes arising from these Terms or your use of the Platform shall be resolved through good-faith negotiation first, and if unresolved, through the courts of Portugal.
